Buzz Media Network Terms of Use

These Terms of Use ("Terms") govern your access to and participation in the Buzz Media Network website, BuzzTrakr page builder, sharing tools, referral program, autoresponder tools, white-label features, advertising features, paid memberships, and related services (collectively, the "Service"). By creating an account, activating a membership, purchasing a paid plan, or continuing to use the Service, you agree to these Terms and to the Privacy Policy. If you do not agree, do not register or use the Service.

These Terms are intended to apply to users in the United States and Canada, subject to mandatory consumer protection, privacy, anti-spam, competition, tax, and other laws that may apply in your location. If a required local law gives you rights that cannot be waived, these Terms will be interpreted to preserve those rights.

1. Eligibility and account rules

• You must be at least 18 years old and able to enter a binding agreement.
• You must provide accurate, complete, and current registration information.
• You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
• You may not create or operate more than one account, impersonate another person, use misleading account information, or use a username or content that violates another person's rights.
• Sponsors/referrers are assigned based on the signup link or other referral logic in effect at registration. Sponsor changes are not permitted after account activation except where Buzz Media Network determines that correction is required by error, fraud, or law.

2. Program, compensation, and earnings claims

Buzz Media Network may provide referral credits, commissions, advertising credits, page views, bonus features, or other benefits according to the compensation plan and account status then in effect. No income, commission, traffic, conversion rate, bonus, or business result is guaranteed. Most participants should expect that results vary and that some participants may earn little or nothing.

Members must not make false, misleading, exaggerated, or unsubstantiated earnings, lifestyle, employment, business opportunity, traffic, conversion, or compensation claims. Any earnings or compensation representation made to a prospective member must be truthful, not misleading, and accompanied by fair, reasonable, and timely disclosure of typical participant results and material costs where required by law, including applicable requirements under United States Federal Trade Commission guidance and Canadian Competition Act rules for multi-level marketing plans.

The Service is not employment. Members are independent participants and are not employees, agents, partners, franchisees, or legal representatives of Buzz Media Network. Members are responsible for their own expenses, taxes, reporting, business licenses, and compliance with laws that apply to their marketing activities.

Members may not operate, promote, or describe Buzz Media Network as a pyramid scheme or as a plan that pays compensation merely for recruitment. Members may not require inventory loading, forced purchases, deceptive advertising, or any payment or action that is prohibited by applicable United States or Canadian law.

3. Marketing, anti-spam, and member conduct

Members are solely responsible for how they advertise or share Buzz Media Network links, pages, templates, banners, emails, text messages, social posts, and other marketing materials. Members must comply with all applicable laws and platform rules, including the United States CAN-SPAM Act, the Federal Trade Commission Act and endorsement guidelines, Canada's Anti-Spam Legislation (CASL), Canadian Competition Act marketing rules, privacy laws, and social network policies.

• Commercial electronic messages may be sent only with legally valid consent.
• Messages must identify the sender and include accurate contact information where required.
• Messages must include a clear, working unsubscribe mechanism where required, and unsubscribe requests must be honored within the required time.
• Members must not use harvested lists, purchased lists without proper consent, forged headers, deceptive subject lines, spam bots, malware, cloaking, or misleading redirects.
• Members must not inflate views, clicks, referrals, earnings, or advertising credits by automated, fraudulent, incentivized, or deceptive means.

Spamming, fraudulent activity, abusive conduct, illegal content, or deceptive marketing may result in suspension, termination, loss of unpaid earnings or credits, and referral to payment processors, platforms, regulators, or law enforcement where appropriate.

4. Paid memberships, billing, cancellation, and refunds

Free accounts may have limited features. Paid memberships, including Pro, Business 1, Business 2, and Custom White Label plans, may renew automatically when purchased through a recurring payment provider. Before paying, you are responsible for reviewing the price, billing interval, renewal terms, included features, and cancellation method shown at checkout or by the payment provider.

You may cancel a recurring paid membership through the payment provider or through any account tools made available by Buzz Media Network. Cancellation stops future renewals when processed by the payment provider. Your account may remain in paid status until the end of the already-paid billing period, after which it may revert to free status and paid-only pages, bonuses, white-label features, positions, or other benefits may be reduced, disabled, or removed.

Unless a refund is required by applicable law or expressly stated at the time of purchase, payments are non-refundable once a billing period begins. Chargebacks, failed payments, or payment reversals may result in account suspension, loss of paid features, and adjustment of commissions or credits related to that payment.

5. User content and intellectual property

Members may create pages, upload images, enter links, use templates, write text, and share content through the Service ("User Content"). You retain ownership of your User Content, but grant Buzz Media Network a non-exclusive, worldwide, royalty-free license to host, store, display, reproduce, adapt, transmit, and distribute it as needed to operate, promote, secure, and improve the Service.

You represent that you have the rights needed to use and share your User Content. You may not upload or link to content that is unlawful, infringing, defamatory, deceptive, obscene, harassing, hateful, malicious, or otherwise harmful. Buzz Media Network may remove or disable content at any time when it believes content violates these Terms, third-party rights, platform rules, or applicable law.

Templates, software, branding, page designs, code, trademarks, and other materials supplied by Buzz Media Network are owned by Buzz Media Network or its licensors. You may use them only as permitted through the Service and may not copy, resell, reverse engineer, or misuse them outside the Service.

6. Privacy, tracking, and data

Buzz Media Network collects and processes account data, referral activity, usage data, payment records, device/browser information, IP addresses, cookies, and other information as described in the Privacy Policy. We use this information to operate accounts, attribute referrals, process payments, provide support, detect fraud and abuse, maintain security, comply with legal obligations, and improve the Service.

No method of transmission or storage is 100% secure. Buzz Media Network uses reasonable safeguards, but cannot guarantee absolute security. Privacy requests and questions may be submitted through the contact page.

7. Suspension, termination, and forfeiture

Buzz Media Network may refuse, suspend, restrict, or terminate access to the Service, withhold or reverse credits, and cancel unpaid earnings when it reasonably believes there has been fraud, abuse, chargeback activity, spam, legal non-compliance, policy violation, security risk, or other conduct harmful to Buzz Media Network, members, users, advertisers, payment processors, or the public.

You may stop using the Service at any time. Discontinued participation, failure to keep contact information current, account inactivity, or failure to comply with these Terms may result in loss of access and forfeiture of unredeemed credits or unpaid earnings, except where prohibited by applicable law.

8. Disclaimers and limitation of liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, Buzz Media Network DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AVAILABILITY, ACCURACY, SECURITY, AND UNINTERRUPTED OPERATION.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, Buzz Media Network AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, SERVICE PROVIDERS, AND LICENSORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, LOST PROFITS, LOST DATA, LOST EARNINGS, LOST GOODWILL, BUSINESS INTERRUPTION, OR SUBSTITUTE SERVICES ARISING FROM OR RELATED TO THE SERVICE OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Some jurisdictions do not allow certain warranty disclaimers or liability limitations. In those jurisdictions, the limitations apply only to the fullest extent permitted by law.

9. Changes, entire agreement, and severability

Buzz Media Network may update these Terms from time to time. Material changes will be posted on this page or communicated through reasonable means. Continued use of the Service after changes take effect means you accept the updated Terms.

These Terms, the Privacy Policy, the compensation plan, payment terms, and any additional policies or disclosures presented in the Service form the entire agreement between you and Buzz Media Network for your use of the Service. If any provision is found unenforceable, the remaining provisions remain in effect. Failure to enforce a provision is not a waiver.
